Terms of Service

Effective April 8, 2026

These Terms of Service ("Terms") govern your access to and use of the PlotONE platform, including our website, web application, and any related services (collectively, the "Service") operated by PlotONE LLC, a Texas limited liability company ("PlotONE," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

PlotONE is a creator campaign analytics and management platform purpose-built for the hospitality industry. The Service enables hotels, resorts, and hospitality brands ("Properties"), marketing agencies ("Agencies"), and content creators ("Creators") to collaborate on influencer marketing campaigns, track content performance, measure earned media value (EMV), and facilitate live shopping commerce.

2. Account Types & Eligibility

Account Types

The Service offers three account types:

  • Property Accounts — for hotels, resorts, and hospitality brands subscribing at the Property tier.
  • Agency Accounts — for marketing and talent agencies subscribing at the Agency tier.
  • Creator Accounts — for individual content creators, available as a free tier or Creator Pro subscription.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By creating an account, you represent that you meet these requirements.

3. Subscriptions & Billing

Subscription Plans

Paid subscriptions are billed monthly in advance. Current pricing is published on our website and may be updated with 30 days' notice to existing subscribers. Your subscription renews automatically each billing period unless cancelled.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a subscription period.

Free Tier

Creator Free accounts are provided at no charge and may be subject to feature limitations. We reserve the right to modify or discontinue the free tier with 30 days' notice.

4. Live Shopping

Creators and Properties may participate in PlotONE's live shopping features, which facilitate product and service promotion during live content. PlotONE collects a platform fee equal to 30% of gross merchandise value ("GMV") processed through the Service. You are responsible for all applicable taxes on transactions you complete through live shopping. PlotONE is not a party to any underlying commercial transaction between a creator, property, or consumer.

5. Content & Intellectual Property

Your Content

You retain ownership of all content you create, upload, or share through the Service ("Your Content"). By using the Service, you grant PlotONE a non-exclusive, worldwide, royalty-free license to use, store, display, and analyze Your Content solely for the purpose of providing and improving the Service.

Campaign Content

When a Creator participates in a campaign initiated by a Property or Agency, the applicable campaign agreement between those parties governs content ownership and usage rights. PlotONE is not responsible for disputes arising from campaign content licensing.

PlotONE IP

The Service, including all software, design, trademarks, and documentation, is owned by PlotONE and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

6. Third-Party Integrations

The Service integrates with third-party platforms including Instagram and TikTok. Your use of these integrations is subject to the applicable third-party terms of service. PlotONE is not responsible for changes to third-party APIs or platforms that affect the Service.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws or regulations.
  • Upload false, misleading, or fraudulent campaign data or metrics.
  • Attempt to gain unauthorized access to any part of the Service or another user's account.
  • Use automated tools to scrape, crawl, or extract data from the Service without written permission.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the integrity or performance of the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PLOTONE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLOTONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. PLOTONE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO PLOTONE IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless PlotONE and its officers, managers, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to access the Service ceases. Sections 5, 8, 9, 10, and 12 survive termination.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas. You waive any objection to personal jurisdiction or venue in such courts.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service at least 14 days before changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
